This one drops into the Plaintiffs' lap. For some reason they decided not to develop any evidence supporting their claims, and it came back to quite cruelly bite them in the butt.

Bingo.

I filed an amicus brief in the Baude v. Heath case, and was one of the attorneys in the original Bridenbaugh v. Wilson case some ten years ago. The plaintiffs' attorneys in this case are experienced and careful, so I doubt they dropped the ball on that point.

I sense it's more Judge Easterbrook's hostility toward commerce clause claims. He wrote the opinion upholding Indiana's ban on direct shipping in the Bridenbaugh case. He may be brilliant, but if he's disinclined to agree with claims of commerce clause violation...
